2.17 SOMETHING I CAN NEVER HAVE

FULL EPISODE SYNOPSIS (spoiler!)

Nikki claims there was a court hearing about custody for Jenny a few weeks ago; and since Jake didn't show she has been awarded custody for the baby. She does not present any papers to prove it, so Jake and Peyton refuse to believe her.

Lucas takes Brooke home. He asks her to stay, even though he knows it is in vain. Brooke is feeling really miserable about having to leave Tree Hill.

Lucas comes to Keith's apartment and finds his mother there. Keith hasn't come home. While they are talking about the situation Keith walks in, overhearing something about Dan's arrangement with Jules. He is hurt that the people he trusted knew about it and said nothing. Keith walks out, he feels there is nothing left to talk about. Karen and Lucas feel terrible.

While putting something away in the garage, Anna finds evidence that Felix was the one who defaced Peyton's locker. Anna is angry and she confronts her brother with it. But he sees nothing wrong with what he did, he thinks it's better that the rumour is about Peyton than about Anna.

Keith goes straight to the dealership. Dan is enjoying his triumph and shows it. Keith is so upset and enraged that he attacks Dan violently; he even tries to strangle him. When Keith is restrained by two men, Dan tells him he is fired. Keith is beyond caring. He throws something through the glass wall, shattering it, and warns his brother that he has nothing left to loose, but Dan does.

Peyton and Brooke don't like the thought of Brooke leaving. They come up with the idea of Brooke staying with Peyton when her parents move to California. Brooke immediately calls her mother, but her mother says no; because Peyton lives alone and she also thinks Peyton is a bad influence for Brooke. Brooke can't believe it.

Anna tells Peyton that it was Felix who spray painted her locker. Peyton isn't all that surprised or upset, though she feels for Anna, sensing how hard it must be for her.

Nathan is on his way to meet Haley at her tour and is reminiscing about the happy times they had together.

Looking for Jake and the baby, Nikki comes to the school, asking Peyton and Brooke about his whereabouts. She is really mean to Peyton, but Brooke is standing up for her friend. Peyton fears, that Jake might run again.

Anna makes a decision and turns in Felix to the school authorities for defacing Peyton's locker. Felix is upset with her about it when he comes home.

Karen is shocked when Lucas tells her that he still wants to stay with Dan. He wants to stay close to his father, to find out what else he is up to. She doesn't like it one bit.

Jake contemplates leaving. Andy recommends taking an attorney. When Jake says he can't afford one, Andy offers to pay for everything and immediately calls his own attorney. Jake is very grateful, though he is aware there is no guarantee for him to win custody.

Karen goes to see Keith. She tells him how she found out about Jules/Emily and hands over the file that Andy's investigator put together about her. Karen also tells him that Emily really loves him. Keith feels hurt, betrayed and confused. He doesn't know what to do.

Peyton tells Brooke what Felix did. Brooke storms right off and breaks up with him. He tries to explain his reasons. Brooke is far too upset about what he did to her best friend, so she is not listening.

Dan is pleased when Lucas tells him that he will stay. He reasons that Dan kept his promise, despite of how things turned out, so he should keep his promise as well. Furthermore, Dan is also paying for his medication, which Lucas can't do without.

Haley is very surprised to find Nathan backstage. She is between two songs, so they don't have much time to talk. Haley confesses her confusion, she feels overwhelmed with everything has happened to her in such a short span of time; her marriage, the music. Nevertheless, Haley tells Nathan she is happy to see him and asks him to stay until after the show, to talk then. But when she comes off the stage Nathan has gone.

Felix is upset because his parents are sending him to a military school. Anna finally tells her brother that she is gay and his behaviour made her afraid to be who she is. But not anymore. Felix is stunned; he doesn't want to hear this. Anna cries when he turns away and leaves the room without another word.

Lucas surprises Brooke with the news that she can stay in his old room with Karen. All her belongings have already been moved there. Brooke is speechless. Karen convinced Brooke's parents to let her stay until the summer. Lucas says he wasn't ready to loose her yet. Brooke is overjoyed.

A little later Karen lays down the rules for Brooke. Before she can even finish speaking, Brooke hugs her, saying it's just like having a real mom. Her own parents never took much interest in her doings. Karen is a little surprised by the girl's unexpected reaction.

Lucas finds Keith packing his car. He apologizes. Keith still feels betrayed by Lucas for not telling him about Jules/Emily. Keith doesn't know if he will come back; for the first time he isn't sure there's anything left in Tree Hill for him to come back to.

Later that evening Lucas happens to see Dan hiding something in the ceiling of his office, without his father noticing him.
